Thank you for the opportunity to present this proposal. We would be pleased to assist you with your Management and Culinary hiring needs. This agreement addresses the fee structure for all management level positions, for:
Rise Soufflé Holdings, LLC
Our fees are earned only in the event that a candidate referred by us accepts an offer from your company or any of its affiliates within one year of our referral. The employer acknowledges its obligation to pay Hospitality Pro Search should any member of its staff, directly or indirectly, cause the hire of an individual introduced to them, directly or indirectly, by Hospitality Pro Search. All positions secured through Hospitality Pro Search are secured on an “employer paid” basis only.
FEES:
A fee of 10% of the candidate’s annual salary at his /her hire date – per candidate hired, for any culinary or management candidates, including:
General Manager / Assistant General Manager / Assistant Manager / Bar Manager Kitchen Manager / Assistant Kitchen Manager / Chef / Sous Chef / Unit administrative
A fee of 10% of the candidate’s annual salary at his /her hire date –per candidate hired for any Corporate, President or Vice President, Director of Operations, or Senior management position
GUARANTEE:
Hospitality Pro Search will guarantee all placements for a period of one Hundred Twenty Days (120), (180 for Corporate Positions) from the start date of the employee. If an employee is dismissed for any reason other than reduction in workforce, Hospitality Pro Search will offer a one time replacement, at no charge, provided that the payment has been received in full within the specified terms of the contract.
PAYMENT IS DUE IN FULL- NET 10 DAYS FROM THE CANDIDATE’S START DATE.
IF HPS CONDUCTS THE BACKGROUND CHECK, THE CANDIDATE CAN NOT BEGIN WORK UNTIL THE REPORT IS COMPLETED & REVIEWED BY RECRUITER AND CLIENT.
THIS AGREEMENT SHALL BE GOVERNED BY THE LAWS OF THE STATE OF TEXAS. ALL DISPUTES ARISING UNDER THIS AGREEMENT SHALL BE RESOLVED IN CONROE – MONTGOMERY COUNTY, TEXAS, AND TEXAS LAW SHALL GOVERN.
IN THE EVENT HOSPITALITY PRO SEARCH IS REQUIRED TO EMPLOY LEGAL COUNSEL OR TO INCUR ANY OTHER EXPENSE TO ENFORCE TIMELY PAYMENT UNDER THIS CONTINGENCY AGREEMENT, IT SHALL BE ENTITLED TO RECOVER THE AMOUNT OF ALL REASONABLE ATTORNEYS’ FEES OF SUCH COUNSEL AND ALL OTHER EXPENSES INCURRED IN ENFORCING SUCH OBLIGATION.
